She can't "read or write", but was still able to graduate from High
School? I feel sorry for this family, but maybe it would be best for this baby
to end up being adopted by a family that can function in society.
Who is the father? Where is the father?
If this woman's mental state was stable enough for her to live on her own
and have a job, she has no excuse for discarding her newborn baby in a trash
can. Clearly she has issues, but the confession came from her own mouth, "I
thought the baby would die and all my problems would be solved." This is
negligence and attempted murder and should be treated as such.
what a sad situation, the family is low functioning but want to raise that baby
although in reality,that baby would be better off with another loving mother and
father that can provide a good life. My amazing and wonderful daughter who has
not been able to have any children would be so perfect for this baby. She is
looking for adoption.
If she was special needs, how come she was never diagnosed with anything? How
do you graduate high school without being able to read or write or again,
without being diagnosed? And, what kind of man gets a mentally unstable woman
pregnant? We need more accountability from the biological father.
The school bus stops coming at 22. You graduate whether you know how to read or
write when you are disabled. She could not have gotten the job help without a
determination of a need. The school helps with transfer to a job. A job like
getting the carts together at the supermarket doesn't require literacy.
There are people to help with the filling out of forms. In this case she could
very well be a victim of rape. If she isn't capable of consenting to
relations she is a victim. The court needs to figure out if she was able to
consent, if so the father needs to be involved in the life of the child. If not
he may need to do time, unless he to has a deficit, he could have been the
victim. If they can raise the child with support of family then the child should
be with the family. Again just cause you don't have a disability
doesn't mean the child should just go to you because you are
I find it amazing many including myself were supportive of the mom who
accidentally left their baby in the car, and she isn't facing charges. Yet
this young mom is not in full health and mind. In this case we hopefully will
have a live child when all is said and done. It is none of our business what her
special need is. I hope we can be happy to let the system find family and
supports. We aren't asking for the other moms other children to go to
family services to supply people who don't have children with children
because of her error. I am an adoptive parent. It is not about better. That is
entitlement. She may be a victim of a crime as well. Was she being supervised by
the state? It may not be her bio family that failed.
Something doesn't add up.It is not possible to graduate high
school without being able to read and write unless you have a special education
classification which requires a diagnosis.How can these grandparents
have not know their daughter was pregnant? If she was as needy as they claim
don't you think they would pay attention to something as obvious as, say,
"Graduating" from HS may or may not mean the same thing for a disabled
student as it means for a general education student. There are certificates of
completion which means they basically did their time or the classes may have
been completed with special education credits. Even without an official medical
diagnosis, there should be a special education classification if she really has
a learning disability. Surely they will get things sorted out. In any case,
this poor girl should be allowed to see her parents or even out on bail if she
really does have a disability. She's probably confused & scared to
death sitting in jail.
There are 3 elements to determining if there has been criminal intent, one of
which is having the mental state that you know what you're doing. This
young woman may not have had the mental capacity to refuse sex nor to know what
to do with a baby. She may not have even had the capacity to know she was
pregnant. Only the psychologists can determine that.
That this gal was living on her own is not a declaration of mental capacity. We
have plenty of leaders in this nation who's sanity might be questioned as
we witness irresponsible decisions. Being able to wash dishes, make a bed and
turn over a portion of money received in exchange for rent and heat doesn't
prove that she was able to understand much more than that.Perhaps
the baby would be better off adopted, but again, this isn't proof of
criminal intent. If the community is determined to see someone punished, then
get some DNA sampling and locate the father; who I suspect knowingly took
advantage of this gal's diminished mental capacity for his own pleasure
without regards to her well being or potential offspring from the encounter, or
possibly, encounters. It is easy to convince such a young lady that sex is a
way of being a 'grown up'.
If she didn't understand what she was doing, then she down't have the
necessary "understanding" to be a responsible parent, and the child
should have been taken from her.
Don't be too quick to judge this woman as a criminal. It is obvious she did
not understand what she should do.
Let's pray for the baby's full recovery. It may become a blessing for
a couple waiting a long time to have a dream fulfilled of a child in their home.
During my lifetime I have known individuals with mental capacities way below
what is considered normal, graduate from high school. Society tries to assist
that person to a better station in life and it doesn't always work.
Dumping a baby in a garbage can is not "normal" but it is done by less
and less due to the no fault law. I side first with the baby and her ability to
survive and then to have compassion for this young, frightened, and mentally
insecure woman. Hopefully there will be no victims in this case and
all will survive the mistake made.
I am questioning the understanding of her parents. They report that their
daughter was never diagnosed, but she was in special education. She also reads
at the third grade level.Children who are in special education
classes must have a "diagnosis" in order to be placed in these programs.
The purpose of these classes is to provide the services they need to get the
most out of their education. The help she received from the school vocational
counselors was because she was unable to function in a "regular" job.
The mother complained that without a diagnosis, she didn't receive the
help she needed.Each year the school is required by law to prepare
an individual education plan for every special education student. This not only
includes academic plans, but any therapies (occupation, speech, physical)
necessary. The parents review the proposed plan. The school is then under
mandate to provide the services outlined in the plan.
It usually requires a Doctor to make a diagnosis of a special need. If the
family was impoverished, that may not have been an option. The school system
will test, use measuring tools, psychologists, resource people etc. to determine
Individualized Education Plan needs, but don't have the ability to make a
medical "diagnosis", or prescribe medication that may help. Though
they can suspect and speculate, the parents would still need to visit a doctor,
which costs money.Some special needs people have a really high pain
threshold. It's possible she could labor and deliver without crying out.
You'd think the amount of blood would have tipped off the mother though
that this wasn't an ordinary period. And why not be alerted about a towel
being carried outside? So many questions that will be determined as this thing
Perhaps the Trauma of being arrested and jailed will underline the importance of
not throwing a baby in the trash like a piece of rubbish to be disposed of.

Choosing sterilization for a mentally handicapped adult child by his/her
conservator parents has been legal for years. The sad but indisputable truth is
that certain mentally handicapped individuals may not now nor will ever be
competent to choose between bearing or not bearing children, or among methods of
contraception. Pregnancy is not a right. Ignoring prenatal care for the
growing baby, which appears to be the case here, may even intrude on the rights
of the child.
Hockeymom is incorrect in her belief that a doctor could make a determination of
the special needs of the child. An MD may note that there are special needs,
but the school staff has trained personnel to make the specific diagnosis
required for special education services.The school psychologist can
test to determine the student's mental capacity and learning potential. A
doctor is not qualified to do this. There was no indication that the woman
needed medication; there is no medication to improve mental capacity. It's
common for someone receiving special education services to have more than one
diagnosis.The school staff works as a team to make the correct
diagnoses of all the student needs. They also work together, with the parents
to create the Individual service plan.
