They ought to lower the age to 12.
Two things, 1) a child should not be forced at any age to choose between his/her
parents. The responsibility for time sharing should be placed on parents who,
post divorce, may need to 'grow up' and make a mature decision that
allows the child to spend time with both parents instead of acting like children
in a sand box who can't share, 2) I can't believe I'm on the same
side of this issue as the Eagle Forum. I guess there is good in all.
Of course the wife doesn't want 50/50 joint physical custody, regardless of
the child's wishes. (BTW, way to go kid, insisting on fairness and equal
time with each of your parents.) That would reduce or even eliminate her child
support and reduce her control over the situation. My ex had the same view,
only worse, taking away overnights and limiting my time with my young daughter
as much as possible, all to protect her child support. This case and bill show
exactly what is wrong with child custody -- it's inherently unfair and
often leads to destructive power struggles. The standard should be 50/50 shared
custody when 2 fit parents are involved, with no move-aways allowed. There
should be NO gender preferences for child custody.
